  • Tzedek America Adult Trip Waiver and Program Terms & Conditions

In consideration of my participation in the above referenced Tzedek America program (the “Program”), I acknowledge and agree to the following terms and conditions:

    1. Program Participation
Tzedek America programs are group travel and educational experiences. Participants are expected to be capable of caring for themselves during the Program and participating in the activities described in the applicable program itinerary.

Participants are responsible for reviewing the Program itinerary and any information provided regarding physical requirements, activity level, travel arrangements, accommodations, and other program considerations before participating.

Tzedek America reserves the right to limit, suspend, or terminate a participant’s participation when Tzedek America reasonably determines that the participant’s condition or actions may affect the health, safety, or well being of the participant or other members of the group.

    2. Activity Level and Physical Requirements
Participants are responsible for honestly assessing their ability to participate in the activities included in the Program.

Depending on the specific Program, activities may include walking, standing for extended periods, navigating stairs, walking on uneven terrain, traveling by motorcoach or other transportation, and participating in outdoor or other physically active experiences.

Participants should carefully consider the physical requirements of their specific Program and communicate any accommodation or support needs to Tzedek America in advance. Tzedek America will make reasonable efforts to accommodate participants when possible.

    3. Safety and Assumption of Risk
I understand that participation in the Program involves inherent risks, including the risk of personal injury, illness, death, or loss of or damage to personal property.

These risks may arise from travel, transportation, lodging, walking, outdoor activities, excursions, weather conditions, environmental hazards, illness, accidents, crime, civil unrest, natural disasters, transportation delays or disruptions, or other circumstances that may occur during the Program.

I understand that some risks may be known or unknown, foreseeable or unforeseeable, and that Tzedek America cannot eliminate all risks associated with travel and participation in Program activities.

I acknowledge that I have voluntarily chosen to participate in the Program and knowingly assume responsibility for my own health, safety, and welfare during the Program, to the fullest extent permitted by applicable law.

    4. Release and Waiver of Liability
I hereby release, waive, discharge, and covenant not to sue Tzedek America, its officers, directors, employees, advisors, contractors, consultants, agents, representatives, Trip Leaders, volunteers, and affiliated organizations (collectively, the “Released Parties”) from claims for loss, damage, injury, illness, death, or loss of or damage to personal property arising out of or related to my participation in the Program, including participation in Program activities and events, to the fullest extent permitted by applicable law.

This release includes claims arising from the ordinary negligence of Tzedek America or the Released Parties, to the fullest extent permitted by applicable law.

Nothing in this Agreement is intended to release, waive, or limit any liability that cannot legally be released, waived, or limited under applicable law.

    5. Independent Third Party Suppliers
Tzedek America programs may include transportation, accommodations, meals, excursions, activities, guides, community organizations, and other services provided by independent third parties.

Tzedek America may use independent transportation companies, hotels, restaurants, guides, community organizations, and other suppliers in connection with its Programs. These suppliers are independent contractors and are not employees of Tzedek America.

To the fullest extent permitted by applicable law, Tzedek America is not responsible for the independent acts, omissions, delays, or failures of third party suppliers, except to the extent such liability cannot legally be excluded.

    6. Participant Responsibility
Participants are responsible for their own actions and decisions throughout the Program and are expected to follow reasonable instructions from Tzedek America staff, Trip Leaders, guides, transportation providers, and Program partners.

Participants are also responsible for their personal belongings throughout the Program.

    7. Participant Conduct
Tzedek America expects all participants to conduct themselves in a respectful and appropriate manner throughout the Program.

Participants are expected to follow reasonable instructions from Tzedek America staff, Trip Leaders, guides, transportation providers, and Program partners and to conduct themselves in a manner that does not interfere with the safety, well being, or enjoyment of other participants.

Tzedek America reserves the right to take appropriate action when a participant’s conduct negatively affects the Program or other participants.

    8. Admission and Termination of Participation
Tzedek America reserves the right to limit, suspend, or terminate a participant’s participation in a Program when Tzedek America reasonably determines that the participant’s condition or actions are inappropriate, disruptive, or adversely affect the health, safety, or well being of the participant or other members of the group.

Tzedek America may take action on an individual or group basis when circumstances require such action.

If a participant’s participation is terminated, the participant may be responsible for any additional costs associated with leaving the Program, including transportation, lodging, meals, or other expenses.

    9. Program Changes
Tzedek America makes every effort to operate Programs as described in program materials and itineraries. However, itineraries, activities, accommodations, transportation, schedules, and other aspects of a Program may change due to circumstances beyond Tzedek America’s reasonable control.

Such circumstances may include weather, natural disasters, illness, public health concerns, transportation issues, strikes, civil unrest, changes in local conditions, or other unforeseen circumstances.

Tzedek America will make reasonable efforts to communicate significant changes to participants and will make reasonable adjustments when necessary to protect the health, safety, and well being of participants or to address circumstances beyond its control.

Participants are expected to remain flexible and understand that changes may occasionally be necessary.

    10. Personal Travel Arrangements
Unless otherwise stated in the applicable Program materials, participants are responsible for making their own travel arrangements to and from the Program, including transportation to the Program’s starting location and from the Program’s ending location.

Participants are responsible for any costs, fees, penalties, or changes associated with their personal travel arrangements.

Participants are encouraged to carefully consider their travel plans and allow sufficient flexibility for possible changes to the Program schedule.

    11. Cancellation and Credit Policy
Tzedek America program fees are nonrefundable. Participants who cancel their participation 30 or more days before the Program start date will receive a program credit equal to the amount paid. The credit may be applied toward another Tzedek America tour within 12 months of the cancellation date.

All cancellations must be submitted to Tzedek America in writing. Cancellations made less than 30 days before the Program start date are not eligible for a credit, except at the sole discretion of Tzedek America.

Program credits are nontransferable, nonrefundable, and subject to availability. If the participant applies the credit toward a future tour with a higher program fee, the participant is responsible for paying the difference.

No refunds or credits will be provided for a participant’s voluntary departure from the Program after it has begun or for termination of participation resulting from a violation of Program policies, the Participant Code of Conduct, or these Terms and Conditions.

Participants are responsible for their own airfare and other personal travel expenses. Tzedek America does not offer or provide travel insurance. Participants are strongly encouraged to purchase travel insurance that provides coverage for trip cancellation, trip interruption, illness, emergencies, airfare, and other unexpected circumstances. Tzedek America is not responsible for reimbursing airfare, travel insurance premiums, or other personal travel expenses.

Tzedek America’s cancellation and credit policy applies to all participants unless otherwise stated in the applicable Program information or registration materials.

    12. Photography and Video
Tzedek America may take photographs, videos, or other audio or visual recordings during its Programs.

Participation in a Tzedek America Program does not require consent to being photographed, filmed, or recorded. I have indicated my preference regarding photography and video in the Photo/Video Consent question included in this registration. If I have indicated my consent, I authorize Tzedek America and its partner organizations to use my image, likeness, and voice for promotional, educational, Program related, and organizational purposes, including advertising, social media, websites, publications, presentations, and other communications, consistent with the choice I have made.

I understand that I will not receive compensation for the use of my image, likeness, or voice, regardless of whether I consent to being photographed or recorded.

    13. Indemnification
To the fullest extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the Released Parties from and against claims, liabilities, damages, losses, costs, and expenses arising from or related to my participation in the Program or from my acts or omissions during the Program, except to the extent prohibited by applicable law.

    14. Acknowledgment of Program Information
I acknowledge that Tzedek America makes reasonable efforts to plan and operate its Programs with consideration for participant health and safety. However, I understand that Tzedek America cannot eliminate all risks associated with travel and participation in Program activities.

I have had the opportunity to review the Program information, including any applicable activity level, physical requirements, travel arrangements, and other Program considerations, and I am voluntarily participating with an understanding of the risks involved.

    15. Applicable Law
These Terms and Conditions and my relationship with Tzedek America shall be governed by applicable California law, except to the extent otherwise required by law.

    16. Severability
I expressly agree that this Tzedek America Adult Trip Waiver and Program Terms & Conditions is intended to be as broad and inclusive as permitted by applicable law.

If any provision is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

I understand that this Agreement is intended to be legally binding to the fullest extent permitted by applicable law.

I HAVE READ THIS AGREEMENT CAREFULLY AND VOLUNTARILY AGREE TO ITS TERMS. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST TZEDEK AMERICA AND THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
